Terms of Use

The rules and responsibilities that apply when you use Jampak, organize or attend a show, or purchase a ticket.

1. About Jampak

Welcome to Jampak. Jampak (“Jampak,” “we,” “us,” or “our”) operates a platform for the independent live-music community. Artists, hosts, creative professionals, organizers, and audiences can use Jampak to publish profiles, discover collaborators and spaces, coordinate shows, list events, and offer or purchase tickets (collectively, the “Platform”).

Jampak provides the technology that helps people connect and transact. Unless a listing expressly says otherwise, the organizer identified on the listing—not Jampak—produces and operates the event.

2. Acceptance and Eligibility

These Terms of Use (“Terms”), together with our Privacy Policy and any additional terms presented for a particular feature, govern your use of the Platform. By accessing or using Jampak, you agree to these Terms. If you do not agree, do not use the Platform.

You must be at least 18 years old and able to enter into a binding agreement to create an account, organize a show, receive a payout, or make another legally binding commitment through Jampak. A minor may attend an event only with any consent or supervision required by law and the organizer’s rules.

If you use Jampak on behalf of a business, venue, collective, or other organization, you confirm that you are authorized to accept these Terms for that organization. “You” then includes both you and the organization.

3. Accounts and Profiles

You may browse public parts of the Platform and, where available, purchase tickets as a guest. An account is required to create a profile, organize or join certain shows, access dashboard features, or receive payouts.

When you create or use an account, you agree to:

  • Provide accurate, complete, and current information.
  • Keep your password, sign-in links, and account access secure.
  • Promptly update information that changes or is no longer accurate.
  • Accept responsibility for activity performed through your account, except to the extent caused by Jampak’s breach of these Terms or applicable law.
  • Notify us promptly if you suspect unauthorized access or misuse.

You may not sell, gift, license, or transfer an account to another person without Jampak’s written permission. Profiles may be public, so do not publish information you do not want others to see.

4. Shows and Organizers

Users may propose, accept, organize, promote, host, or provide services for shows through the Platform. The people who accept a proposal are responsible for reviewing the show details and any agreed terms before accepting them.

Organizers and hosts are responsible for:

  • Providing accurate event descriptions, dates, locations, prices, accessibility information, age restrictions, and entry rules.
  • Obtaining required permissions, licenses, insurance, permits, and rights for the venue, performers, music, images, and other event content.
  • Operating the event safely and complying with applicable laws, capacity limits, and venue requirements.
  • Honoring accepted show terms and communicating material changes to affected participants and ticket holders.

Jampak may review, reject, unpublish, or remove a profile or listing that violates these Terms, creates a safety or legal risk, or could mislead users.

5. Tickets, Payments, and Payouts

Event listings may offer tickets (“Tickets”) for sale. When you submit an order, you offer to purchase the selected Tickets at the displayed price. Your purchase is accepted when a confirmation is issued and payment is successfully authorized or completed.

You authorize Jampak and its payment processor, Stripe, to charge the payment method you provide for the order total, including any displayed fees and applicable taxes. Stripe collects and processes payment-card information under its own terms and privacy policy. Jampak receives transaction identifiers and related payment status information, not your complete card number.

Prices are displayed in the currency stated on the event listing. Your bank or payment provider may charge currency-conversion, overdraft, foreign-transaction, or other fees. Jampak is not responsible for fees imposed by your financial institution.

Ticket inventory is limited. Placing a Ticket in checkout does not guarantee availability until the order is confirmed. Jampak may cancel duplicate, fraudulent, unauthorized, or technically erroneous orders and issue any refund required by law.

Artists, hosts, and other payout recipients must provide accurate onboarding information to Stripe and satisfy Stripe’s verification requirements. Payouts may be delayed or paused if required information is missing, inaccurate, or under review.

6. Changes, Cancellations, and Refunds

Event start times, end times, lineups, programs, and other details may change. Organizers may make non-material changes when reasonably necessary. If an organizer or Jampak determines that a change is material, affected Ticket holders may be offered a refund or another remedy as described in the notice about that change.

Unless the event listing, applicable refund policy, or law says otherwise, Tickets for a specific date are not refundable because you change your mind or do not attend.

  • Cancelled events. If an event is cancelled, affected Ticket holders will generally receive a refund of the Ticket price and any other amount required by law.
  • Rescheduled events. Tickets will generally remain valid for the new date. If a refund is offered, you must request it by the deadline stated in the rescheduling notice.
  • Processing time. Approved refunds are returned to the original payment method. Your bank or payment provider controls how long the credit takes to appear.

7. Event Access and Conduct

A Ticket is a personal, revocable license to attend the listed event. It does not guarantee entry if you do not comply with these Terms, the event listing, reasonable venue rules, or applicable law.

An organizer or venue may refuse entry to or remove a person who:

  • Cannot present a valid Ticket or required identification.
  • Creates a safety or security risk.
  • Is intoxicated, threatening, abusive, disruptive, or likely to cause injury, damage, or serious nuisance.
  • Possesses illegal items, weapons, ammunition, explosives, fireworks, or another item reasonably considered dangerous or disruptive.
  • Fails to follow reasonable instructions from event or venue staff.

You also agree that you will not:

  • Bring outside food or drink unless the listing or organizer expressly permits it.
  • Smoke where smoking is prohibited.
  • Use professional photography, video, or audio equipment without the organizer’s permission.
  • Interfere with performers, staff, other attendees, neighboring properties, or the operation of the event.

8. Event Conditions and Recording

You are responsible for your personal property at an event. To the extent permitted by law, Jampak and event organizers are not responsible for property that is lost, stolen, or damaged. You are responsible for damage caused by you or a member of your party.

Events may include loud sound, flashing or strobe lighting, video displays, crowds, audience participation, smoke or atmospheric effects, and exposure to communicable illness. Review available event information and make decisions appropriate for your health and safety. If a condition causes distress, notify event staff and leave the area.

A listing or venue may impose age restrictions. Unless the listing says otherwise, an attendee under 16 must be accompanied by a responsible adult, and any attendee under 18 must have any permission required by a parent or legal guardian.

Security cameras, photographers, and audio or video recording may be present at an event. By attending, you understand that your image, likeness, or voice may appear incidentally in event footage. Where permitted by law, Jampak, the organizer, or an authorized third party may use that footage in any media for event documentation, promotion, security, or other disclosed purposes without additional compensation. If you have concerns, speak with the organizer before or during the event so they can explain available options.

9. User Content and Feedback

“User Content” means profile information, images, videos, messages, listings, descriptions, links, and other material you submit to the Platform. You retain any ownership rights you have in your User Content.

You grant Jampak a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and distribute User Content as reasonably necessary to operate, improve, secure, and promote the Platform and the profiles or shows you choose to publish. This license ends when the content is deleted, except for copies reasonably retained in backups, transaction records, or materials already created with your permission.

You confirm that:

  • You own your User Content or have permission to submit it.
  • Your User Content does not violate another person’s intellectual property, privacy, publicity, contractual, or other rights.
  • Your User Content is not unlawful, deceptive, defamatory, abusive, discriminatory, or harmful.

If you voluntarily provide feedback or suggestions, you allow Jampak to use them without restriction or payment to you.

10. Acceptable Use

You may not:

  • Break the law, violate another person’s rights, or use the Platform for fraud, harassment, threats, or abuse.
  • Impersonate another person or organization, misrepresent an affiliation, or create deceptive profiles or listings.
  • Introduce malware, overload or disrupt the Platform, bypass security controls, or attempt unauthorized access.
  • Scrape, crawl, mine, copy, or extract Platform data through automated means without Jampak’s written permission.
  • Reverse engineer, decompile, or attempt to discover source code, except where applicable law does not allow that restriction.
  • Use another person’s account or collect information about other users without authorization.

11. Jampak’s Rights

The Platform, including its software, design, branding, text, and other content provided by Jampak, is owned by Jampak or its licensors and is protected by intellectual-property laws. Subject to these Terms, Jampak gives you a limited, personal, non-exclusive, non-transferable, revocable right to use the Platform for its intended purpose.

You may not use Jampak’s name, logos, trademarks, or other brand features without written permission. You may print or save Platform content for personal use only if you keep all ownership notices intact, do not modify the content, and do not use it in a way that violates Jampak’s or another person’s rights.

12. Suspension and Account Closure

If you violate these Terms or create a legal, financial, fraud, safety, or security risk, Jampak may limit, suspend, or terminate your access; remove content or listings; cancel affected transactions; refuse event entry where Jampak is authorized to do so; or take other reasonable action. We may also report suspected illegal activity to the appropriate authorities.

You may close your account from your account settings. Some information may be retained or anonymized as described in the Privacy Policy, including records needed to complete events, fulfill Tickets, process refunds or payouts, maintain financial ledgers, resolve disputes, or comply with law.

Provisions that by their nature should survive account closure or termination—including payment obligations, ownership, disclaimers, liability limits, indemnification, and general legal terms—will remain in effect.

13. Availability and Third Parties

We work to keep the Platform available and accurate, but it may experience maintenance, delays, errors, outages, security incidents, or feature changes. The Platform is provided on an “as available” and “as is” basis to the extent permitted by law.

The Platform may contain links to or integrations with third-party services, including payment, authentication, mapping, social-media, and venue services. Jampak does not control and is not responsible for third-party content, availability, security, or practices. Your use of a third-party service is governed by that service’s terms.

Jampak is not responsible for another user’s conduct, statements, services, venue, equipment, or performance. Use reasonable judgment when communicating, collaborating, transacting, or meeting through the Platform.

14. Disclaimers and Liability

To the fullest extent permitted by law, Jampak does not guarantee that a profile, listing, organizer, attendee, venue, service provider, event, or User Content is accurate, reliable, safe, available, or suitable for you. Jampak is not responsible for an event organizer’s cancellation, schedule change, admission decision, rule enforcement, or failure to perform an agreement.

Neither Jampak nor an event organizer is responsible for losses that were not reasonably foreseeable when the relevant agreement was made, or for indirect, incidental, special, consequential, business, reputational, or lost-profit damages, except where applicable law does not allow those exclusions.

To the fullest extent permitted by law, Jampak’s total liability arising from a Ticket, event, or your use of the Platform will not exceed the greater of the amount you paid for the Ticket or event giving rise to the claim and $100.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud or for death or personal injury caused by negligence where applicable law provides.

15. Your Responsibility to Jampak

To the extent permitted by law, if a third party brings a claim against Jampak because of your User Content, your event, your services, your conduct, or your violation of these Terms, you agree to defend, indemnify, and hold Jampak harmless from the resulting claims, damages, losses, liabilities, and reasonable legal costs. Jampak may control the defense of a claim, and you agree to provide reasonable cooperation.

16. Changes and General Terms

Changes to the Platform or these Terms

Jampak may add, change, suspend, or discontinue Platform features. We may also update these Terms to reflect changes to the Platform, our practices, or applicable requirements. Updated Terms take effect on the date stated in the notice or when posted. If a change is material, we may provide additional notice through the Platform or by email. Your continued use after the effective date means you accept the updated Terms.

General provisions

  • If part of these Terms is unenforceable, the remaining provisions will remain in effect.
  • A delay in enforcing a provision does not waive the right to enforce it later.
  • You may not assign your rights or obligations under these Terms without Jampak’s written permission. Jampak may assign its rights and obligations as part of a merger, reorganization, financing, sale, or transfer of the Platform.
  • These Terms do not create third-party beneficiary rights except where they expressly say otherwise.
  • Neither party is responsible for delay or failure caused by events beyond its reasonable control, such as natural disasters, utility or internet failures, labor disputes, government action, public-health emergencies, or civil unrest.
